Pursuant to Section 25 of the Municipalities
Act the municipality is responsible for the construction,
maintenance, repair and replacement of the portion of
the utility service connection from the main lines of
the systems or works to the boundary of the street,
road or easement.
The municipality shall be responsible
for the costs of the repairs, maintenance or replacement
of the curb stop.
The owner of property with utility service
lines shall be responsible for any repair, maintenance
or replacement of the utility service lines from the
curb stop to the interior face of the outer walls of
the structure serviced.
Pursuant to Section 25(2), as a term
of supplying the utility service the Council of the
municipality, may make the owner responsible for the
costs of construction, maintenance, repair and replacement
of the portion of the service connection from the main
lines of the system or works to the boundary of the
street, road or easement.
No repairs, maintenance or replacement
of the utility services lines from the mains to the
outer line of the street shall be undertaken, without
prior approval of the municipal Council.
It is the owner’s responsibility
to conduct an audit of their main resident valve to
detect if the valve is in working order.
When and if the Town utility crew are
called to shut off a curb stop to allow an owner to
repair their main resident valve; and if it is after
normal working hours or on the week-end, the property
owner will be charged for the call-out and will be responsible
for the financial pay for the municipal utility crew’s
hours.
